Privacy Policy

This document discloses the privacy practices of the mobile device applications, “Q App” and “Q Host,” and the website, Qwaitlist.com, owned and operated by Q Technologies Incorporated, a Washington corporation (collectively “Q App,” “us,” “we” or “our”). As part of the normal operation of Q App, we collect and, in some cases, disclose information about you. This Privacy Policy describes the information we collect about you, how Q App may use such information, and what may happen to that information. By using Q App, you expressly consent to our use and disclosure of your personally identifiable information in accordance with this Privacy Policy. This Privacy Policy is incorporated into and subject to the Terms of Use of Q App. Q App will collect, use, and disclose your personal information as described in this Privacy Policy.

Minors

If you are a minor (under the age of 18), you can use Q App only with the consent and under the supervision of your parents or legal guardians. If you are a minor, please do not submit any personal information to Q App. IF YOU ARE 13 YEARS OR YOUNGER, PLEASE DO NOT USE Q APP OR ANY OF ITS SERVICES FOR ANY PURPOSE. Q App is not intended for any children under the age of 13. We do not knowingly collect any information from anyone who is under 13 years of age. If we become aware that any individual under the age of 13 has provided us with information, we will take steps to remove such information and terminate the child’s account. If you are informed that your child has provided us with information without your consent, please contact us at customerservice@qwaitlist.com.

Information We Collect

Your Registration Information. To fully use Q App, you will need to register in Q App, where you will be required to provide us with your contact information and certain other personal information, namely, your first and last name, email address, and mobile telephone number. If you choose to register, you agree to: (a) supply the information requested in the registration process, (b) ensure that all the information you supply to us is accurate, and (c) update your personal information. You may choose not to provide us with any registration information. In such an event, you can still access and use some portions of Q App; however, you will not be able to access and use portions of Q App that require your registration information.

Your Usage of Q App.

We automatically track certain information about you based upon your use of Q App. We use this information to conduct internal research on our users’ demographics, interests, and behavior to better understand and serve our users. This information is compiled and analyzed on an aggregate basis. Q App uses location services of mobile devices to know the location of users for providing map services, showing restaurants close to your location, and collection of taxes where required. Your personal usage of Q App is tracked and you may be provided with statistics including but not limited to how much time you saved using Q App.

Your Correspondence.

If you send us e-mails, letters or other personal correspondence, or if other users or third parties send us correspondence about your activities or postings on Q App, we may collect such information into a file specific to you.

Your Payment Account.

Q App is a pay for service app requiring a form of payment such as Apple Pay, Credit Card, PayPal, Google Wallet, or other services. Q App collects but does not store your payment information. We utilize payment services that store your information. The settings section of Q App enables you to update your payment account information when required.

Our Use of Your Information

Q App. We use your information collected on Q App for purposes of implementing our services through Q App. For example, we may use your information to: place you on a waitlist for a restaurant that you request, change your status on a waitlist, make payments through Q App, understand you and your preferences to personalize your experience and pleasure using Q App, such as understanding your dining history to make recommendations about other restaurants you may want to waitlist.

Internal Purposes.

We use your information to conduct internal research on our users’ demographics, interests, and behavior to better understand and serve our users. We may also prepare and keep statistical records and other data about you and other users of Q App. We may hire third parties to help us collect and analyze such data, and we may share such statistical data with third parties.

Restaurant Partners.

Your information and aggregate user traffic information is shared with our restaurant partners to advise them on certain user information, including, but not limited to, total user visits on certain days, number of remote Q App users compared to walk-up, no-show statistics, user dining preferences including food, beverage, and table selection. This data may also be used to ascertain specific user behaviors or preferences such as how long users typically are seated, and the types of restaurants users most frequently visit. We use this information to help us make Q App more useful to users–to learn about the number of visitors to Q App, what part of Q App they are interested in, how long the use Q App, and the types of technology our visitors use. By providing your mobile phone number, you expressly consent to receive direct dial calls and text messages at that number from our restaurant partners relating to your position on a waitlist.

Promotional Use.

We may use your personal information to send you advertisements, promotions, and notices in relation to our marketing and promotional efforts, and to improve our content and services. We may also use your information to deliver to you advertisements, new services and promotions, and other information to you that is targeted to your interests. We may also use your information to deliver to you third-party advertisements and promotions, our new services and promotions, and other information and notices. We may use third-party advertising companies to serve ads on our behalf. These companies may employ cookies and action tags also known as single pixel gifs or web beacons to measure advertising effectiveness. Any information that these third parties collect via cookies and action tags is completely anonymous.

Administrative Notices, etc.

We may use your e-mail address, mailing address, and phone number to contact you regarding administrative notices, new product offerings, and communications relevant to your use of Q App. If you do not wish to receive these communications, you may have the ability to opt out of receiving these notices on your account status page.

Billing and Support.

If you open a credit account with Q App, we may use your address and billing information to bill you and provide associated support.

Dispute Resolution.

We use information we obtain from you to resolve disputes, troubleshoot problems and enforce our Terms of Use.

Changes to Your Personal Information.

In the event that any of your personal information you may have provided to Q App has changed, or should you ever notice a mistake or error with respect to any of your information on Q App, you should promptly notify Q App at customerservice@qwaitlist.com and provide the updated or correct information so that we will have current and accurate information about you.

Our Disclosure to Third Parties

We use practices that are consistent with standards in our industry to protect your privacy. We cannot, however, promise that any of your personally identifiable information or private communications will remain private. For example, third parties may unlawfully intercept or access information, transmissions or private communications on Q App. We do not sell or rent any personally identifiable information about you to any third party. The following describes some of the ways that your personally identifiable information may be disclosed.

Law Enforcement.

It is the policy of Q App to release users’ personal identifying information and any other information when Q App reasonably believes such disclosure is appropriate to comply with applicable law, to enforce any of our contracts or agreements, to protect the rights, property or safety of our users and customers, in response to a governmental authority request or to legal process, or for purposes of fraud protection. We reserve the right to fully cooperate with any law enforcement authorities or court orders requesting or directing us to disclose the identity of anyone posting any content, or publishing or otherwise making available any materials on Q App.BY USING Q APP YOU WAIVE ALL RIGHTS AND AGREE TO HOLD US HARMLESS FROM ANY CLAIMS RESULTING FROM ANY ACTION TAKEN BY US DURING OR AS A RESULT OF ANY INVESTIGATIONS AND/OR FROM ANY ACTIONS TAKEN AS A CONSEQUENCE OF ANY INVESTIGATION BY EITHER US OR LAW ENFORCEMENT AUTHORITIES

Advertisers.

We disclose aggregate information about our users to advertisers and for other marketing and promotional purposes. However, we do not disclose any personally identifying information to any of these entities.

On Q App.

If you create a User ID on Q App, you are identified by your User ID throughout Q App. Unless you select a unique User ID, our system automatically sets your User ID as your e-mail address. In this situation, where you are identified on Q App by your User ID, you disclose your e-mail address to other users and third parties. As a result, other users and third parties might send you unsolicited e-mail and be able to personally identify all of your activities on Q App. Even if your User ID is not your e-mail address, your User ID can be used to identify you and your activities throughout Q App. Other people can see your activities on Q App, including any of your comments and postings on the Site, and so on.

Third Party Suppliers.

We may use third party suppliers to assist us in providing the services available on Q App or an outside website or application. Whenever a third party supplier desires to collect information about you, you will be notified of the involvement of the third party supplier, and you will never be required to disclose any information to the third party supplier.

Use Limited to Q App-Related Communications.

Because of the nature of the services offered on Q App, Q App allows you to access other users’ contact information. You may use such information only for Q App-related communications. Q App-related communication expressly excludes unsolicited commercial messages. Therefore, you must not text, post, upload, link or otherwise use Q App in any manner for any commercial purpose or endeavor, including the offering for sale of any products or services, or otherwise engage in any commercial activity on Q App for any purpose, including, but not limited to, conducting raffles or contests, displaying sponsorship banners, soliciting goods or services, soliciting funds, advertisers or sponsors. In all cases, you must give users an opportunity to remove themselves from your database and a chance to review what information you have collected about them. In addition, under no circumstances can you disclose personally identifiable information about another user to any third party without our consent and the consent of such other user after adequate disclosure by you to such other user. Note that law enforcement personnel, our commercial program participants, and other rights holders are given different rights with respect to information they access.

No Spam.

Q App and our users do not tolerate spam. Therefore, without limiting the foregoing, you are not licensed to add a Q App user to your contact list (e-mail, telephone number or physical mail) without their express consent after adequate disclosure.

Security.

We use reasonable measures to maintain the security of your information; however, no company, organization, online community, or mobile application, including Q App, can fully eliminate security risks associated with your personal information. We will have no liability to you or to any third-party arising out of any such loss, misuse, destruction, or alternation.

Affiliates.

We may share some or all of your personal information with our parent company, subsidiaries, joint ventures, or other companies under a common control (“Affiliates”), in which case we will require our Affiliates to honor this Privacy Policy. If the assets related to Q App are acquired by another company that company will possess the information collected by us and it will assume the rights and obligations, regarding your information as described in this Privacy Policy.

Disclosures You Make to Third Parties

When you waitlist through Q App or otherwise use the services of Q App, information you choose to share with a restaurant may be used by the restaurant for its own purposes. Q App does not control, and is not responsible for, the privacy practices of restaurants. Please contact the restaurant directly if you want to learn about its privacy practices. Q App may provide, or third parties including Q Apps users, may provide links to other World Wide Websites, applications or resources which are not maintained by or related to Q App. Links to such third party sites are provided as a service and convenience to our users, but they are not sponsored by, endorsed or otherwise affiliated with Q App. Please be aware that Q App is not responsible for the privacy practices or the content of those other websites or applications. Q App does not control the privacy policies of third parties, and Q App makes no representations or warranties to you about the privacy, content, quality or accuracy of any linked website, application, or restaurant. When you disclose information to third parties on Q App (or any other website or application) about yourself, you are subject to the privacy customs and policies of that third party. It is your responsibility to find out about the privacy policy of any such third parties. You acknowledge and agree that your use of such third party websites and applications and disclosures to restaurants are entirely at your own risk and Q App is not responsible or liable, directly or indirectly, for any damage or loss caused by or alleged to have been caused by or in relation to your use of such websites and applications or disclosures to restaurants, including any loss or damage from any privacy violation or privacy breach that may occur as a result of such use or any failures and/or disruption to your computer system or mobile device that results from such use.

Changes to Privacy Policy

Q App reserves the right at any time to make changes, modifications, alterations and/or additions to this Privacy Policy from time to time, in its sole and absolute discretion, without notice to you. We reserve the right, at any time and without notice, to add to, change, update or modify this Privacy Policy, by posting such change, update or modification on the Q App. Any such change, update or modification will be effective immediately upon posting. Accordingly, you should review this Privacy Policy periodically to determine if any changes have been made. Your continued use of Q App after any changes have been made to the Privacy Policy signifies and confirms your acceptance of any such changes or amendments to the Privacy Policy.
