1. Introduction

For purposes of this Privacy Policy, references to the “Company,” “we,” “our,” and “us” mean Q Technologies Incorporated, a Washington State corporation. The Company operates the website at www.qwaitlist.com, and provides the mobile applications Q Waitlist Guest App and Q Host (collectively, “Q Waitlist”). This Privacy Policy explains how and why we collect, use, and disclose information about you collected through Q Waitlist. We reserve the right to change, modify, add, or remove portions of this Privacy Policy from time to time. We will not, however, retroactively change how we share your personal information without your consent. We will provide notice of any material changes through Q Waitlist or by other means as we deem appropriate before they take effect. Please check back periodically for any changes we may make to the Privacy Policy. Your continued use of Q Waitlist following the posting of changes to this Privacy Policy means you accept these changes.

2. Personal Information We Collect

When you interact with Q Waitlist, we may collect personal information, such as:

We may also collect general information about the equipment you use to access Q Waitlist; your operating system and browser type; the services that you use, times, dates, and details of your interactions with Q Waitlist; and software event data.

3. How We Use Information

Provide the products and services you've requested or agreed to receive, such as placing you on a restaurant waitlist, adding you to a party, changing your status on a waitlist, providing notifications (e.g., text messages) related to your waitlist status, providing reports on the number of restaurants you visited and the time you saved using Q Waitlist, and facilitating transactions.

Market our products and services to you and send you marketing materials that may be of interest to you, including information about restaurants and new features.

Enable you to participate in Q Waitlist features.

Process your account registration.

Respond to your questions or other requests, and provide administrative notices.

Improve and manage Q Waitlist.

Contact you regarding your use of Q Waitlist.

For other purposes with your consent.

4. How We Collect Information

We may collect information:

Directly from you when you provide it, including by filling out forms, setting up an account, or contacting us by email, letters, or other forms of correspondence.

Automatically as you interact with Q Waitlist, such as location data, data on browsing activities and patterns, times and dates of logins, and event data.

From third parties, including analytics, communications, advertising, and payment processors that the Company uses to operate Q Waitlist.

5. How We Share Information

We do not sell your personal information to third parties.

We do share personally identifiable information with restaurants when you request to be placed on their waitlist through Q Waitlist, or agree to be added to a party that is on a waitlist: the restaurant will receive your name, phone number, and any other information you may voluntarily provide at that time.

BY REQUESTING TO BE PLACED ON A RESTAURANT WAITLIST THROUGH Q WAITLIST, OR AGREEING TO BE ADDED TO A PARTY ON A WAITLIST, YOU CONSENT TO THE RESTAURANT RECEIVING YOUR NAME AND PHONE NUMBER, AND TO THE RESTAURANT CALLING AND SENDING YOU TEXT MESSAGES RELATING TO THE WAITLIST.

Your personally identifiable information is deleted from the restaurant Q Host App at the end of every day. Further, restaurants have no rights to retain any information provided as part of utilizing the Q Waitlist system.

We do share your personal information with third parties ONLY in the following circumstances:

Third Parties Providing Services on Our Behalf. We use third parties to host and operate Q Waitlist, Q Waitlist features, and perform administrative, analytics, payment processing, advertising, communications, and ecommerce services. We only disclose enough information to these companies so they can carry out these services. These companies are bound by contractual obligations to keep personal information confidential.

Administrative and Legal Reasons. We may also disclose personal information if required to do so by law or in the good-faith belief that such action is necessary to (a) conform to applicable law or comply with legal process served on us; or (b) protect and defend our rights or property, or that of Q Waitlist, its users, or the public.

Business Transfer. We reserve the right to disclose and transfer all information related to Q Waitlist, including, without limitation, your personal information, demographic information, and usage information: (1) to a subsequent owner, co-owner, or operator of Q Waitlist; or (2) in connection with a corporate merger, consolidation, restructuring, the sale of substantially all of our stock and/or assets or other corporate change, including, without limitation, during the course of any due diligence process.

Aggregated Data. We may share non-personally identifiable information, such as aggregated user statistics, wait time, and restaurant traffic information, with third parties, including restaurants.

6. Links to Other Websites and Services

This Privacy Policy does not apply to third-party websites or services, and we are not responsible for the practices employed by websites or services linked to or from Q Waitlist, including the information or content contained therein. We are also not responsible for the privacy practices of the restaurants with whom you share your personal information: while we take steps to reduce the amount of personal information received by these restaurants, they may nevertheless find a way to retain your personal information and use it in ways other than as set forth in this Privacy Policy. Finally, except as we expressly state otherwise, this Privacy Policy does not apply to information we collect by means other than through Q Waitlist (including offline).

7. Security

We store personal information collected via Q Waitlist in secure operating environments that are not available to the public. Only our employees and agents who need access to your personal information to do their jobs are allowed access.

While we make reasonable efforts to safeguard your personal information, no transmission of data over the Internet or any other public network can be guaranteed to be 100% secure. As a result, we cannot ensure or warrant the security of any information you transmit to us or information we transmit to you, and you assume all related risks. Restaurants with whom you share personal information may also have different security practices and procedures.

We may retain your personal information until you request that we delete it as described below. In certain cases, we may continue to retain your data to complete a transaction requested by you, to comply with our legal obligations, in connection with a legal claim, or as otherwise permitted by law.

We do NOT retain your personal payment information such as credit card number. We use third party payment services to process any payment, or store payment information.

8. Other Information

Cross-Border Transfer. Q Waitlist is hosted on servers in the United States and is intended for only U.S. and Canadian users. Any personal information you provide to us will be processed and stored on servers in the U.S., the laws of which may be deemed by other countries to have inadequate data protection. If you are located outside the U.S., you consent and continue to consent to the processing and storage of such data in the U.S.

Children’s Information. Q Waitlist is not intended for nor directed to children. We do not knowingly collect personal information from children under the age of 13. If you have reason to believe that a child under the age of 13 has provided their personal information to us, please contact us, and we will delete that information.

9. Your Choices and Our Contact Information

If you choose not to provide personal information, you may be unable to access or use certain portions or features of Q Waitlist. For example, adding your party to a restaurant wait list, and notifications related to your waitlist status, require that you provide your personal information.

Accessing Your Personal Information. If you would like to obtain a copy of your personal information gathered by Q Waitlist, or if you would like us to correct or delete such information from our records, please contact us using the contact information below to submit a request. If you submit a verifiable request to delete your information, we will direct our third-party service providers to delete any of your information in their possession

Opting Out. If you no longer wish to receive promotional and marketing communications or other communications from Q Waitlist, you may opt out by contacting us at the information below. You can stop receiving email communications from us by using the “unsubscribe” mechanism provided in such communications.

Improper Collection and Misuse of Personal Information. Please report any improper collection or misuse of personal information provided on Q Waitlist to us at the contact information below.
